Terms of use for the GHG monitoring tool

ifeu - Institut für Energie- und Umweltforschung Heidelberg gGmbH (hereinafter referred to as ifeu) has developed the GHG monitoring tool as part of the FlyingLess project. By accessing and using the tool, you agree to the following terms of use. Please read these terms carefully before using the tool. If you do not agree to these terms, please do not use the tool.

The GHG monitoring tool is used to determine GHG emissions from flights caused by travelers, for example as part of a business trip. After successful registration, an Excel list filled out according to a predefined template can be uploaded for calculation as part of the service provided here. Once the calculations have been completed, a results table in the form of an Excel file is made available for download in a protected user area.

These Terms of Use apply to the use of the GHG Monitoring Tool, related services, data and information and the related activities of the persons or organizations using it. By accessing and using the tool, you acknowledge and agree to be bound by these Terms of Use.

The ifeu reserves the right to amend these terms of use at any time and without stating reasons. The current version of the Terms of Use can be viewed by clicking on the "Terms of Use" hyperlink at the end of the website. These terms of use then apply in principle to all transactions made after they come into force.

Any person who has successfully completed the registration process and has been granted access by ifeu is authorized to use the service subject to compliance with the conditions set out here. Use is voluntary. There is no entitlement to use the service, as funding is not guaranteed after the end of the project period in fall 2024. ifeu may withdraw users' access to the service and delete their account at any time and without giving reasons. However, ifeu will attempt to maintain the service with updated data beyond the project duration without guarantee.

3.1 Permitted use: If you have successfully completed the registration process and have been granted access by ifeu, you are authorized to use the service subject to the conditions listed. Use is voluntary. You may use the tool to perform calculations, generate results and gain insights based on the functions provided. The tool may be used free of charge exclusively for non-commercial purposes and only for balancing the flights of your own organization.

3.2 Prohibited activities: You agree not to use the tool for illegal, fraudulent or unauthorized purposes.

• You may not reproduce, distribute, modify, create derivative works of, reverse engineer, decompile or disassemble any part of the Tool.
• You may not attempt to gain unauthorized access to the Tool's systems or networks.
• You may not transmit viruses, worms or malicious code to the Tool's systems or networks.
• You must not use the Tool in any way that could infringe intellectual property rights or violate the privacy of others.

Current, complete and correct information on the requested data must be provided during the registration process. You as the user are solely responsible for maintaining the confidentiality of your password and account information. You are also solely responsible for all activities on your account. You undertake to inform the operator of the website (ifeu) of any unauthorized use of your account or any other breach of security. The ifeu shall not be liable for any damages that arise in any way if third parties use your password or your account with or without your knowledge. You may be held liable for losses incurred by ifeu or any other party due to the use of your account or password by a third party. It is not permitted in any way to use the account of a third party without their express permission.

When using the GHG monitoring tool, data is processed that is required for the use of the tool in general or optionally for in-depth analyses. This document summarizes the information on data use in the context of the FlyingLess G HG monitoring tool.

The participating institutions can use this contract template for the commissioned processing of personal data in accordance with Art. 28 para. 3 GDPR.

Please contact info@flyingless.de with regard to requests for deletion of personal data (account and user information) as well as individual uploads for the calculation and generated result files.

6.1 Changes: We reserve the right to modify, suspend or discontinue the Tool or any part thereof at any time without prior notice.

6.2 Termination: We may, in our sole discretion, terminate or suspend your access to the Tool without notice if we believe that you have violated these Terms of Use or applicable law. Furthermore, there is no entitlement to future use of the service, as funding is not guaranteed after the end of the project term in October 2024. However, ifeu will attempt to maintain the service with updated data beyond the project duration without guarantee.

When using the results or outputs of the service in any form, reference must at least be made to the website of the FlyingLess project or the GHG monitoring tool. Citation of the documentation is desired. A correct source reference should be made according to the following pattern: "created with the FlyingLess GHG monitoring tool, https://flyingless.de/. Further information here: https://flyingless.de/thg-rechner."

Otherwise, the provisions of the legal notice in section 3 of the disclaimer apply.

For the content on this website and the use of the service, the warranty is governed by German law § 524 BGB. This means that ifeu assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against ifeu relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded, unless there is evidence of wilful intent or gross negligence on the part of ifeu. All offers are subject to change and non-binding.

The service has been compiled to the best of our knowledge and with the greatest possible care on the basis of current scientific findings and the data available within the scope of the project. However, the use of the service, the use of the results and the activities derived from them are entirely the responsibility of the person or organization using the service. No liability whatsoever is assumed by ifeu for this. It is your responsibility to independently verify the accuracy and suitability of the results generated by the tool before making any decisions or taking any action based on these results.

There is no claim to functionality, timeliness, accuracy or compliance with specific standards or other accounting regulations. The underlying methodology is described here. Updating of the emission factors and changing basic data is planned, but is in no way guaranteed.
